Can I drink in a Class A Motorhome?

If I am traveling across country and stop my motor home is a secure place (not a campground), can I set back and enjoy a few beers? I would be over the limit to drive, so I would be sleeping it off in the motor home. Can I be arrested for open container, DUI or anything like that? At what point does the motor home become a home and not a vehicle? Would this make a difference if the vehicle is running and I am in the back (to run heat/air)?

    The RV should have a separate generator to power the heat/AC so you shouldn’t have to run the engine.

    As long as you are not behind the wheel of the RV, you can kick back and have a few beers. If you get behind the wheel or start driving while you are still impaired, then you could face DUI charges, RV impounded & other headaches that you probably wish to avoid.

    Since it is classed as an RV, the laws are slightly different when it comes to sitting in the living/sleeping area with a TV on drinking beer versus sitting in the back of a car with a beer and a portable TV. If you step outside with the beer in your hand, you could still face an open container or public intox charge.
